EasyAiMenu – Cancellation and Refund Policy
1. Introduction
This Cancellation and Refund Policy ("Policy") governs all matters relating to the cancellation of subscriptions and the eligibility for refunds in connection with the EasyAiMenu Platform ("Platform"), operated by Octakris IT Solutions LLP ("Company", "We", "Us", "Our").
This Policy forms part of the EasyAiMenu Terms of Service available at https://easyaimenu.com/terms and should be read in conjunction with those Terms. By subscribing to the Platform, You agree to be bound by this Policy.
2. Subscription Fees
Subscription fees are charged by Octakris IT Solutions LLP for access to the EasyAiMenu Platform. Fees are based on the subscription plan selected by You at the time of onboarding or upgrade, as communicated within the Platform or at https://easyaimenu.com/pricing.
All subscription fees are inclusive of applicable Goods and Services Tax (GST) where required under the GST Act, 2017. GST-compliant tax invoices will be issued for all payments.
3. No Refund Policy — Subscription Fees
All subscription fees paid to Octakris IT Solutions LLP are unconditionally non-refundable under any circumstances whatsoever, including but not limited to: early cancellation of subscription, dissatisfaction with Platform features or AI functionality, technical issues or downtime, non-use or underuse of the Platform, business closure, change of ownership, change of business model, regulatory changes affecting your business, or any other reason of any kind.
By subscribing to the Platform, You explicitly and irrevocably acknowledge and agree to this No Refund Policy. No exceptions, partial refunds, pro-rata credits, or account credits will be granted under any circumstances.
4. Cancellation by You
4.1 How to Cancel
You may cancel your subscription at any time by:
- Using the subscription management settings within your admin panel, or
- Sending a written cancellation request to [email protected] from your registered email address
4.2 Effect of Cancellation
- Cancellation takes effect at the end of your current paid billing cycle
- You will retain full access to the Platform until the last day of the paid billing period
- No refund or pro-rata credit will be issued for any unused portion of the subscription period
- Following the end of the paid period, your account will enter the expiry and dormancy process as described in Section 12.4 of the Terms of Service
4.3 Data After Cancellation
Upon cancellation and expiry of the paid period, your data will be retained for a period of 30 (thirty) days, after which it may be permanently deleted. You are strongly advised to export all menu data using the Platform's Menu Export feature prior to cancellation.
5. Cancellation by Us
5.1 Cancellation for Cause
Octakris IT Solutions LLP may cancel and terminate your subscription immediately and without prior notice in the following circumstances:
- Breach of the Terms of Service or this Policy
- Non-payment of subscription fees
- Fraudulent, abusive, or illegal use of the Platform
- Violation of the Fair Usage Policy
- Requirement by applicable law, court order, or regulatory authority
In cases of cancellation for cause, no refund or credit note will be issued.
5.2 Cancellation Without Cause
If Octakris IT Solutions LLP cancels your subscription for reasons other than those listed in Section 5.1, we will issue a credit note for the pro-rated value of the unused portion of your current subscription period. Such credit note will be issued within 15 (fifteen) business days of the cancellation date and may be applied to a future subscription with EasyAiMenu.
6. Free Trial Cancellation
If you are within a free trial period, you may cancel at any time before the trial ends with no charge. If you do not cancel before the end of the free trial period, your account will automatically transition to the selected paid subscription plan and your Payment Method will be billed accordingly. The No Refund Policy in Section 3 applies from the moment paid billing commences.
7. Payment Disputes
If You believe that an incorrect amount has been charged to your Payment Method, You must notify us in writing at [email protected] within 15 (fifteen) days of the charge. We will investigate and respond within 7 (seven) working days. Chargebacks initiated with your payment provider without first contacting us may result in immediate suspension of your account pending resolution.
8. Processing Timeline
Where a credit note is issued under Section 5.2, the credit will be processed and communicated to you within 15 (fifteen) business days. Where any refund is mandated by a competent court or regulatory authority, it will be processed within 30 (thirty) days of such order.
9. Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN THE TERMS OF SERVICE, IN NO EVENT WILL OCTAKRIS IT SOLUTIONS LLP OR ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY CANCELLATION OR REFUND MATTER. OUR TOTAL LIABILITY IN CONNECTION WITH ANY CANCELLATION, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL NOT EXCEED THE SUBSCRIPTION FEE LAST PAID BY YOU FOR THE IMMEDIATELY PRECEDING BILLING CYCLE. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR SUBSCRIPTION.
10. Governing Law
This Policy is governed by the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the dispute resolution mechanism set out in the EasyAiMenu Terms of Service (Section 13), with the seat of arbitration in Rajkot, Gujarat, India.
11. Amendments
Octakris IT Solutions LLP reserves the right to update this Policy at any time. Updated versions will be posted at https://easyaimenu.com/cancellation-and-refund-policy with a revised effective date. Your continued subscription after we change this Policy constitutes your acceptance of the changes. If you do not agree to any changes, you must cancel your subscription.
