EasyAiMenu – Terms of Service
1. Acceptance of Terms
By accessing, registering for, or using the EasyAiMenu platform ("Platform") available at https://easyaimenu.com, you ("Restaurant Operator", "Tenant", "You") agree to be legally bound by these Terms of Service ("Terms"). These Terms form a legally binding contract between You and Octakris IT Solutions LLP ("Company", "We", "Us", "Our"), a limited liability partnership registered in Gujarat, India (LLPIN: AAH-9923).
Your continued use of the Platform — including accessing any restaurant admin panel, waiter application, or guest-facing features — constitutes your full and unconditional acceptance of these Terms. If You do not agree, You must immediately cease use of the Platform.
2. About the Platform
EasyAiMenu is a multi-tenant Software-as-a-Service (SaaS) platform designed for restaurant businesses operating in India. The Platform enables Restaurant Operators to:
- Create and publish digital menus accessible to guests via QR codes
- Accept and manage dine-in, takeaway, and parcel orders
- Manage guest check-ins, SMS OTP verification, and table sessions
- Configure and deploy an AI-powered voice and text assistant (AI Sommelier) for guests
- Manage staff (Managers and Waiters), tables, discount codes, and promotional content
- Generate and print Kitchen Order Tickets (KOTs) and GST-compliant customer receipts
- Store and manage menu images, branding assets, and restaurant media via cloud storage
- Configure menu periods, happy hour pricing, and time-based item availability
3. Eligibility
To subscribe to and use EasyAiMenu, You must:
- Be a legally registered business or sole proprietor operating a food and beverage establishment in India
- Have full legal authority to enter into this agreement on behalf of your business
- Be at least 18 years of age
- Not be prohibited from using the Platform under any applicable Indian law or regulation
By accepting these Terms, You represent and warrant that all of the above eligibility conditions are satisfied.
4. Restaurant Operator Accounts
4.1 Account Credentials
Each Restaurant Operator is assigned a unique tenant environment identified by a slug, subdomain, or custom domain. You are solely responsible for:
- Maintaining the confidentiality of all admin login credentials
- All activities and transactions carried out under your account
- Promptly notifying us at [email protected] in the event of unauthorized access or suspected security breach
You are solely responsible for maintaining the security of your password. You should not share your username, password, or any other security credentials with any person. If we receive instructions using your registered email and password, we will consider that you have authorized those instructions. Octakris IT Solutions LLP shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your login credentials.
4.2 Staff Access
You may grant access to staff members (Managers and Waiters) via the Staff Management section of your admin panel. Waiter authentication uses a restaurant-specific 6-digit Login ID combined with staff email or phone and password. All actions performed by your staff within the Platform are your responsibility as the account holder.
4.3 Platform-Level Admin Access
Authorized personnel of Octakris IT Solutions LLP may access your restaurant account using an admin impersonation function, solely for support, troubleshooting, or account management purposes. All such access events are logged and conducted exclusively for legitimate operational reasons.
5. Subscriptions and Payments
5.1 Subscription Plans
Access to the Platform is provided on a paid subscription basis. Available plans, pricing, and included features are communicated during onboarding or displayed within the Platform. Plans may include Standard and Premium tiers; Premium features include advanced branding customization such as custom color themes and restaurant logo upload.
5.2 Billing
All subscription fees are charged and collected by Octakris IT Solutions LLP, Rajkot, Gujarat, India. Billing may be conducted via:
- Automated recurring billing through integrated payment processors (such as Razorpay)
- Manual invoicing issued directly by Octakris IT Solutions LLP
All payments are processed in Indian Rupees (INR) unless otherwise agreed in writing. Applicable Goods and Services Tax (GST) will be levied and charged in accordance with the GST Act, 2017. GST-compliant tax invoices will be issued for all subscription payments.
5.3 No Refund Policy
All subscription fees paid to Octakris IT Solutions LLP are strictly and unconditionally non-refundable under any circumstances whatsoever. This includes, without limitation: early cancellation or termination of subscription, dissatisfaction with Platform features or AI outputs, technical issues or downtime, non-use or underuse of the Platform, business closure, change in business ownership, change in business model, or any other reason of any kind.
By subscribing to and using the Platform, You explicitly acknowledge, understand, and irrevocably agree to this No Refund Policy. No exceptions, partial refunds, or account credits will be granted under any circumstances.
5.3A Free Trial (If Applicable)
From time to time, Octakris IT Solutions LLP may offer a free trial period for new Restaurant Operators. Where a free trial is offered:
- The duration of the free trial will be as specified at the time of sign-up or as communicated by us
- You will not be billed during the free trial period
- Upon expiry of the free trial, your account will transition to the selected paid subscription plan and billing will commence automatically unless you cancel before the trial period ends
- Octakris IT Solutions LLP reserves the right to modify, extend, or discontinue free trial offers at any time and at its sole discretion
- Free trial terms do not override or modify the No Refund Policy in Section 5.3 once a paid subscription commences
5.4 Subscription Cancellation
You may cancel your subscription at any time via your account settings or by writing to [email protected]. Cancellation takes effect at the end of your current billing cycle. You will retain full access to the Platform until the end of the paid period. No refunds or pro-rata credits will be issued for any unused portion of the subscription period following cancellation.
5.5 Suspension for Non-Payment
If subscription fees are not paid when due, Octakris IT Solutions LLP reserves the right to suspend or terminate your access to the Platform without further notice. We will endeavour to notify You before suspension takes effect. Reactivation following suspension requires full settlement of outstanding dues and may attract a reactivation fee at Our sole discretion.
5.6 GST Compliance and Receipt Accuracy
Octakris IT Solutions LLP is a GST-registered entity in Gujarat, India. Tax invoices will be issued for all subscription payments. If You are a GST-registered business, please provide your GSTIN at the time of or following subscription to ensure that invoices are correctly issued.
Octakris IT Solutions LLP is not responsible for any errors, omissions, or inaccuracies in GST calculations, GSTIN details, or tax invoices generated through the Platform that arise from incorrect configuration, data entry, or settings by the Restaurant Operator. Restaurant Operators are solely responsible for ensuring the accuracy of all tax-related configuration on their account, including GSTIN, CGST percentage, and SGST percentage values.
6. Permitted Use and Restrictions
6.1 Permitted Use
You may use the Platform exclusively for the lawful operation of your restaurant business in India, including menu management, order processing, staff and table management, guest interactions, and other operational functions described in Section 2.
6.2 Prohibited Activities
You agree not to, and shall not permit any third party to:
- Use the Platform for any unlawful purpose or in violation of any applicable Indian law or regulation
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Platform
- Resell, sublicense, rebrand, or white-label the Platform or any of its features without prior written consent from Octakris IT Solutions LLP
- Upload, post, or transmit any content that infringes intellectual property rights, is defamatory, obscene, fraudulent, or unlawful under Indian law
- Introduce malware, ransomware, viruses, or any malicious code designed to harm or disrupt the Platform
- Circumvent, disable, or interfere with any access controls, rate limits, tenant isolation, or security features of the Platform
- Use the Platform's AI features to generate harmful, misleading, abusive, or illegal content
- Collect, scrape, or harvest data relating to other tenants, their menus, or their guests from the Platform
- Impersonate any person, business, or entity
- Submit false, fabricated, or misleading feedback, reviews, or ratings about the Platform or any restaurant using the Platform
- Submit any content or data via automated processes, scripts, or bots
6.3 Fair Usage Policy
To ensure consistent, reliable, and equitable access to the Platform for all Restaurant Operators, Octakris IT Solutions LLP operates a Fair Usage Policy ("FUP") that applies to all features and resources available on the Platform, regardless of subscription plan. By using the Platform, You agree to use all features in a manner that is reasonable, proportionate to normal restaurant operations, and consistent with the intended purpose of each feature.
6.3.1 Scope of Fair Usage
The Fair Usage Policy applies across all Platform features and resources, including but not limited to:
- AI Features — AI Sommelier interactions (voice and text), Speech-to-Text (STT) transcription calls, Text-to-Speech (TTS) synthesis calls, LLM prompt processing, AI upselling requests, and AI Playground test sessions
- Menu and Catalogue — number of menu categories, menu items, custom fields, menu item variants, and menu period configurations
- Operational Features — number of active tables, staff accounts (Managers and Waiters), discount codes, and promotional slider images
- Order Processing — volume of orders processed per day, per billing cycle, and in real time
- QR Code and Session Activity — number of active guest sessions, QR token scans, and concurrent table sessions
- Storage — total size of uploaded media assets including menu item images, restaurant logos, promotional banners, field icons, branding assets, and exported menu archives stored under your tenant directory
- API Requests — volume and frequency of API calls made directly or via the waiter application or guest-facing web app
- Receipt and KOT Generation — volume of receipt prints and Kitchen Order Ticket generations per billing cycle
6.3.2 What Constitutes Excessive or Abusive Usage
Usage will be considered excessive, abusive, or in breach of this Fair Usage Policy if it:
- Significantly exceeds the volume, frequency, or consumption reasonably expected from a restaurant of your size and operational nature
- Places disproportionate load on shared Platform infrastructure, AI provider API quotas, cloud storage, or database resources in a manner that adversely affects other tenants
- Involves automated, scripted, or bot-driven interactions with the Platform, including automated menu scraping, artificial inflation of QR scans or guest sessions, or bulk AI query generation
- Involves the use of the Platform or its AI features for any purpose other than the genuine day-to-day operation of a food and beverage establishment
- Involves deliberate or repeated triggering of high-cost AI operations (such as STT, TTS, or LLM calls) outside of genuine guest interactions, including for testing, benchmarking, or third-party development purposes without prior written consent from Octakris IT Solutions LLP
- Results in storage consumption that substantially exceeds what is reasonable for a single restaurant's menu and branding assets
6.3.3 Specific Limits and Plan Entitlements
Specific numerical usage limits, storage caps, and per-feature entitlements applicable to each subscription plan are published separately in the Platform's pricing and plan documentation, available within the admin panel or at https://easyaimenu.com/pricing.
Such limits form part of this Fair Usage Policy and are incorporated into these Terms by reference.
Octakris IT Solutions LLP reserves the right to update specific usage limits from time to time. Where limits are updated in a manner that materially reduces entitlements for existing subscribers, we will provide at least 30 (thirty) days' advance notice via email or in-platform notification.
6.3.4 Enforcement of Fair Usage
Where usage is detected that exceeds or abuses fair usage thresholds, we may, at our discretion and depending on the nature and severity of the usage, take one or more of the following actions:
- Notification: Issue a written warning to the account's registered email address identifying the nature of the excessive usage and requesting corrective action within a specified period
- Throttling: Temporarily reduce the rate, speed, or frequency at which specific features are available to your account, such as rate-limiting AI requests or API calls, without full suspension of service
- Soft Cap: Temporarily restrict access to the specific feature or resource that has been excessively consumed until the commencement of the next billing cycle, while maintaining access to all other Platform features
- Hard Cap / Suspension: In cases of severe, repeated, or deliberate abuse, suspend access to the relevant feature or to the entire Platform account pending investigation and resolution
- Termination: In cases of willful, persistent, or egregious abuse of Platform resources, terminate the account in accordance with Section 12 of these Terms
Octakris IT Solutions LLP will make reasonable efforts to notify You before imposing throttling or caps, except in cases where immediate action is required to protect Platform integrity or other tenants.
6.3.5 AI Feature Fair Usage — Specific Provisions
- AI Sommelier interactions are intended solely for genuine guest use during active dining sessions initiated via authenticated QR code access
- Use of the AI Playground is intended for configuration, testing, and prompt refinement only and must not be used as a substitute for production AI interactions or for bulk query generation
- Restaurant Operators who configure their own AI API keys are solely responsible for the usage, costs, and compliance obligations associated with those keys
- Where the Platform provides AI functionality through Octakris IT Solutions LLP's shared API credentials, usage is subject to fair usage thresholds applied at the platform level. Operators whose accounts consistently generate disproportionate AI costs relative to their subscription tier may be contacted to discuss a usage-appropriate plan or to configure their own API keys
6.3.6 Storage Fair Usage — Specific Provisions
- All media assets uploaded to the Platform are stored in tenant-isolated cloud directories and are subject to a storage limit associated with your subscription plan
- Operators are responsible for managing their storage responsibly, including removing unused or duplicate images and assets
- Exported menu archives are intended for backup and migration purposes only and are not to be used as a permanent storage mechanism
- Octakris IT Solutions LLP reserves the right to notify Operators who are approaching or have exceeded their storage limit and to request that unnecessary assets be removed. Where storage is not reduced within a reasonable period following notification, we may restrict further uploads until storage is within the permitted limit
6.3.7 No Additional Charges Without Prior Notice
Octakris IT Solutions LLP will not charge You additional fees for exceeding fair usage limits without first providing You with clear advance notice of the applicable overage charges, the amount due, and an opportunity to either reduce usage or upgrade to a suitable plan.
6.3.8 Good Faith Usage
This Fair Usage Policy is not intended to restrict normal restaurant operations of any scale. It is designed to prevent deliberate misuse, automated abuse, and resource exploitation that would degrade the experience of other users on the shared Platform infrastructure. If You believe that a usage restriction has been applied to your account in error, You may write to [email protected] and we will review and respond within 7 (seven) working days.
7. AI Features and Limitations
7.1 AI Sommelier
The Platform includes an AI-powered assistant called the AI Sommelier that enables restaurant guests to interact with the digital menu via voice or text input. This feature is powered by third-party large language model (LLM) providers, which may include OpenAI, Anthropic, Google Gemini, OpenRouter, and Sarvam AI, as configured in the Platform's AI settings.
7.2 AI Accuracy Disclaimer
AI-generated responses are provided strictly on an "as-is" basis. Octakris IT Solutions LLP does not guarantee the accuracy, completeness, suitability, or appropriateness of any AI-generated output. The AI may occasionally provide incorrect, incomplete, or suboptimal suggestions. Restaurant Operators are fully responsible for configuring AI prompts appropriately and for ensuring that AI behavior is suitable for their establishment and guests.
7.3 Voice Features (STT and TTS)
Speech-to-Text (STT) and Text-to-Speech (TTS) features are provided via third-party voice providers. Guest voice inputs are transmitted to the configured STT provider for transcription and are not permanently stored by the Platform following processing. Use of voice features is also subject to the applicable third-party provider's terms and privacy policy.
7.4 Fallback and Availability
In the event of LLM or voice provider failure or unavailability, the Platform will automatically attempt fallback to configured backup providers. Octakris IT Solutions LLP does not guarantee uninterrupted availability of AI features and accepts no liability for losses arising from AI feature downtime or inaccurate outputs.
7.5 AI Upselling
The Platform includes AI-powered upselling suggestions displayed to guests based on their cart contents. Upselling prompts are customizable by the Platform administrator and by Restaurant Operators. You are responsible for ensuring that all AI upselling prompts configured under your account are truthful, lawful, and compliant with applicable Indian consumer protection laws.
8. Content, Data, and Intellectual Property
8.1 Your Content and Licence Grant
You retain full ownership of all menu data, item descriptions, images, branding assets, pricing information, and other content you upload to the Platform ("Your Content"). By uploading Your Content, You grant Octakris IT Solutions LLP a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, sub-licensable licence to use, host, store, display, reproduce, adapt, modify, translate, and process Your Content solely for the purposes of: (a) delivering the Platform services to You; (b) API integrations with third-party service providers necessary for Platform functionality; and (c) internal quality assurance and service improvement.
You irrevocably waive, and cause to be waived, any moral rights or rights of attribution with respect to Your Content, to the extent permitted by applicable law, in favour of Octakris IT Solutions LLP and its authorised third-party service providers.
You represent and warrant that:
- Your Content was not submitted via any automated process, script, or bot
- Use of Your Content by us and our third-party service providers will not violate or infringe any rights of yours or any third party
- Your Content does not violate these Terms or any applicable Indian law
- You assume all risks associated with Your Content, including reliance by others on its accuracy or quality
8.2 Content Responsibility
You are solely responsible for the accuracy, legality, and quality of Your Content. You warrant that Your Content does not infringe any third-party intellectual property rights, is not misleading, and complies with all applicable Indian laws including the Food Safety and Standards Act, 2006 regarding menu descriptions and food information.
8.3 Platform Intellectual Property
All rights, title, and interest in the Platform — including its code, architecture, design, AI configuration, features, and documentation — are exclusively owned by Octakris IT Solutions LLP. These Terms do not grant You any ownership or proprietary rights in the Platform or its underlying technology. The name "EasyAiMenu" and all associated branding are the intellectual property of Octakris IT Solutions LLP.
8.4 Asset Storage and Public Visibility
Your media assets (menu item images, restaurant logos, promotional banners) are stored in cloud storage in tenant-isolated directories. All uploaded assets are stored with public-read access to enable guest-facing menu display via QR code. You are responsible for ensuring that no sensitive, confidential, or private information is uploaded as a publicly accessible asset.
8.5 Guest Data
Guest personal data (names, phone numbers, OTP records, order information) is collected by the Platform on behalf of You as the Restaurant Operator. Both You and Octakris IT Solutions LLP bear shared responsibility for the lawful collection, processing, and protection of guest data. Detailed data handling provisions are set out in our Privacy Policy at https://easyaimenu.com/privacy.
8.6 Feedback and Testimonials
You may from time to time provide feedback, suggestions, ideas, reviews, ratings, testimonials, or other submissions relating to the Platform or its features ("Feedback"). By submitting any Feedback, You:
- Grant Octakris IT Solutions LLP a perpetual, irrevocable, worldwide, royalty-free, sub-licensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute such Feedback for any purpose, including product improvement, marketing, and promotional materials, without any obligation to compensate You
- Acknowledge that Octakris IT Solutions LLP may edit, reformat, or abridge Feedback prior to use or publication, provided the substance is not materially misrepresented
- Warrant that your Feedback is truthful, does not infringe any third-party rights, and does not contain any confidential or proprietary information of any third party
- Understand that Octakris IT Solutions LLP is under no obligation to act upon, respond to, or implement any Feedback submitted
Octakris IT Solutions LLP is not obligated to keep Feedback confidential. If You have concerns regarding how your Feedback or testimonial has been used or displayed, You may write to us at [email protected] and we will review the matter within 15 days.
9. Third-Party Integrations
The Platform integrates with the following categories of third-party services to deliver its functionality:
- AI/LLM Providers: OpenAI, Anthropic, Google Gemini, OpenRouter, Sarvam AI
- Voice Providers: ElevenLabs, Google Cloud TTS, Sarvam AI
- Payment Processors: Razorpay and other processors as applicable
- Cloud Asset Storage: Amazon S3 or S3-compatible storage providers
- SMS Gateways: For OTP delivery to restaurant guests
Your use of features powered by third-party integrations is also subject to the respective provider's own terms of service and privacy policies. Octakris IT Solutions LLP is not responsible for the accuracy, availability, security, or conduct of any third-party service. Third-party content does not reflect the views of Octakris IT Solutions LLP.
10. Disclaimers and Limitation of Liability
10.1 "As Is" Basis
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Indian law, Octakris IT Solutions LLP expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OCTAKRIS IT SOLUTIONS LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, BUSINESS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.
Our total aggregate liability to You for all claims arising under or in connection with these Terms, whether in contract, warranty, tort (including negligence), or otherwise, shall not exceed the subscription fee last paid by You to Octakris IT Solutions LLP for the immediately preceding billing cycle. These exclusions and limitations of liability will apply to the fullest extent permitted by applicable Indian law and will survive cancellation or termination of your subscription.
10.3 Force Majeure
Octakris IT Solutions LLP shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, internet or network outages, third-party provider failures, government action, or natural disasters.
10.4 Indemnification
You agree to indemnify, defend, and hold harmless Octakris IT Solutions LLP, its designated partners, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with: (a) your use or misuse of the Platform; (b) Your Content; (c) your violation of these Terms; (d) your violation of any applicable law; or (e) any claim by a third party, including restaurant guests, arising from your restaurant's operations or AI configuration.
11. Service Availability and Maintenance
Octakris IT Solutions LLP aims to maintain high availability of the Platform but does not guarantee 100% uptime or uninterrupted service. The Platform may be temporarily unavailable due to scheduled maintenance, emergency repairs, third-party provider outages, or force majeure events. We will endeavour to provide advance notice of scheduled maintenance where practicable. No subscription fee refunds or credits are provided for any period of downtime or service unavailability.
12. Termination
12.1 Termination by You
You may terminate your account at any time by notifying us at [email protected] or using your account settings. Termination does not entitle You to any refund of subscription fees. Your access to the Platform will continue until the end of your current paid billing cycle.
12.2 Termination by Us
We may suspend or terminate your account immediately and without prior notice if:
- You breach any material provision of these Terms
- Subscription fees are not paid when due
- We are required to do so by applicable law, court order, or regulatory authority
- We reasonably determine that your continued access poses a security risk or harm to the Platform, other tenants, or end users
12.2A Credit on Company-Initiated Termination
If Octakris IT Solutions LLP terminates your account for reasons other than breach of these Terms, non-payment, legal obligation, or abuse of the Platform, we will issue a credit note for the pro-rated unused portion of your current subscription period. Such credit note may be applied against a future subscription with us.
For the avoidance of doubt, no credit note or refund will be issued where termination arises from: (a) violation of these Terms; (b) non-payment of subscription fees; (c) fraudulent or abusive use of the Platform; (d) legal obligation or regulatory requirement; or (e) any conduct we determine, in our reasonable discretion, to be harmful to our interests or those of other users.
12.3 Effect of Termination
Upon termination: (a) your right to access the Platform ceases immediately; (b) all outstanding fees remain due and payable; (c) Your Content and account data will be retained for thirty (30) days following the termination date, after which it may be permanently and irrecoverably deleted. You are strongly advised to export your menu data using the Platform's Menu Export function before initiating termination.
12.4 Dormant Accounts and Data Cleanup
If your subscription expires and is not renewed, your account will progress through the following stages:
- Grace Period (Days 1–30 after expiry): Your account will be marked as expired. You will receive email notifications to renew your subscription. Platform access will be restricted or disabled during this period.
- Dormant Status (Days 31–60): If no renewal is made within 30 days of expiry, your account will be marked as "Dormant". During dormancy, you will not be able to access the Platform, admin panel, waiter application, or any guest-facing features. All data remains intact but inaccessible.
- Suspension and Data Cleanup (Day 61 onwards): If your account remains in dormant status for a further 30 days (60 days total from expiry), your account will enter full suspension. Upon or following suspension, all your data — including menu items, orders, guest information, uploaded media assets, staff accounts, and configuration — may be permanently and irrecoverably deleted without further notice.
You are strongly advised to export your menu and data using the Platform's Menu Export feature before your subscription expires. Octakris IT Solutions LLP accepts no liability for data loss arising from account dormancy or suspension under this clause.
Reactivation of a dormant account (before data cleanup) is possible by paying all outstanding subscription dues. Reactivation after data cleanup will require a fresh account setup.
13. Governing Law and Dispute Resolution
These Terms are governed by and shall be construed exclusively in accordance with the laws of India, without regard to any conflict of law principles.
In the event of any dispute, claim, or controversy arising out of or in connection with these Terms or the Platform, the parties shall first attempt resolution through good-faith written negotiation for a period of thirty (30) days from the date of written notice of the dispute.
If the dispute remains unresolved after negotiation, it shall be referred to and finally resolved by binding arbitration conducted under the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Rajkot, Gujarat, India. The language of arbitration proceedings shall be English. The arbitral award shall be final and binding on both parties.
Notwithstanding the above, either party may seek urgent injunctive or other equitable relief from a court of competent jurisdiction in Rajkot, Gujarat.
14. Compliance with Indian Law
The Platform and these Terms are designed to comply with applicable Indian legislation, including:
- Information Technology Act, 2000 and the IT (Amendment) Act, 2008
- IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- Digital Personal Data Protection Act, 2023 (DPDP Act)
- Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
- Goods and Services Tax (GST) Act, 2017
- Indian Contract Act, 1872
- Limited Liability Partnership Act, 2008
- Food Safety and Standards Act, 2006 (to the extent applicable to menu content and descriptions)
15. Grievance Officer (IT Rules 2021 and DPDP Act 2023)
In compliance with Rule 3(2) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023, Octakris IT Solutions LLP has appointed a Grievance Officer:
Any user — Restaurant Operator, Staff member, or Restaurant Guest — may file a grievance regarding any aspect of Platform use, content, data processing, or the use of submitted Feedback or testimonials. Complaints must be submitted in writing to the grievance email address above.
Complaints will be acknowledged within 24 hours and resolved within 15 (fifteen) days of receipt, as required by applicable Indian law.
16. Amendments to These Terms
Octakris IT Solutions LLP reserves the right to modify or update these Terms at any time. Revised Terms will be published at https://easyaimenu.com/terms with an updated effective date. Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the revised Terms.
For material changes, we will make reasonable efforts to notify Restaurant Operators via email or in-platform notification at least 7 (seven) days before the changes take effect.
17. Miscellaneous
Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Waiver: Failure by Octakris IT Solutions LLP to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of such right or provision on future occasions.
Entire Agreement: These Terms, together with the Privacy Policy published at https://easyaimenu.com/privacy and the Cancellation and Refund Policy published at https://easyaimenu.com/cancellation-and-refund-policy, constitute the entire agreement between You and Octakris IT Solutions LLP with respect to the Platform, and supersede all prior negotiations, representations, warranties, or agreements relating to the same subject matter.
Assignment: You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without the prior written consent of Octakris IT Solutions LLP. We may assign our rights and obligations to any successor entity or in connection with a merger, acquisition, or reorganization without your consent.
Language: These Terms are drafted in English. In the event of any inconsistency between this English version and any translation, the English version shall prevail.

A standalone Cancellation and Refund Policy applicable to all EasyAiMenu subscriptions is published at https://easyaimenu.com/cancellation-and-refund-policy and is incorporated into these Terms by reference. In the event of any conflict between the Cancellation and Refund Policy and these Terms with respect to refund or cancellation matters, the Cancellation and Refund Policy shall prevail.
